TERMS OF USE AGREEMENT
Welcome to CRUIZIN’ CONCEPTS MOTORSPORTS! By
accessing and using this Web-site you agree to be bound by these terms and
conditions, which govern the access and use of our web-site(s). Please read the
following terms and conditions carefully.
Your use of the services provided in the
www.cruizinconcepts.com, www.cruizinconceptswholesale.com, foosewheelsdirect.com
or www.mustangwheelsdirect.com domain or any of its subsidiaries (the "Service")
are specifically conditioned upon your agreement to the terms contained in this
Terms of Use Agreement (the "Agreement"). By using the Service, you are agreeing
to all of the terms and conditions contained in this Agreement.
I. USER AGREEMENT – LEGAL INFORMATION
A. MODIFICATIONS TO
AGREEMENT
CRUIZIN’ CONCEPTS MOTORSPORTS may at any time,
and without notice, modify, update, or otherwise change the terms of this
Agreement, and you agree to be bound by such changes. Accordingly, we encourage
you to visit the CRUIZIN’ CONCEPTS MOTORSPORTS Web-site from time to time to
review the current terms and conditions.
B. OWNERSHIP/COPYRIGHT AND TRADEMARKS
Any and all intellectual property rights
associated with the Service and the www.cruizinconcepts.com or
www.cruizinconceptswholesale.com Web-site and its affiliates—including without
limitation any inventive concepts, know-how, publicity rights, trademarks, trade
dress, trade secrets, and copyrights—are the sole property of CRUIZIN’ CONCEPTS
MOTORSPORTS, and may not be copied, reproduced, modified, uploaded, transmitted,
or distributed in any way without CRUIZIN’ CONCEPTS MOTORSPORTS’ written
permission. Except as provided herein, CRUIZIN’ CONCEPTS MOTORSPORTS does not
grant to you any express or implied rights to CRUIZIN’ CONCEPTS MOTORSPORTS’
intellectual property. Any rights associated with content that is transmitted,
downloaded, or otherwise processed by the Service shall be retained by the
content owner, if any, and may be protected by applicable copyright, trademark,
or other laws. For the purposes of this Agreement, the term "Content" refers to
any of the various information, files, data, and media types which can be sent,
received, or processed by the Service in accordance with a variety of protocols,
including, without limitation, text, graphics, video, audio, streaming media,
e-mail, chat, HTML, instant messaging, and the like. This Agreement gives you no
rights in and to such Content. To the extent that you own any rights in Content
that you provide to CRUIZIN’ CONCEPTS MOTORSPORTS, you hereby grant to CRUIZIN’
CONCEPTS MOTORSPORTS a non-exclusive, irrevocable, royalty-free, paid-up license
to use, copy, publish, distribute, publicly perform, publicly display, create
derivative works or otherwise exploit any Content that is provided during your
use of the Service. Any unauthorized use of the materials and content mentioned
herein or on this site may violate copyright, trademark and other applicable
laws and could result in criminal or civil penalties.
"Cruizin Concepts®" is a registered trademark of CRUIZIN’ CONCEPTS MOTORSPORTS,
LLC. No license to use or reproduce this trademark or other trademarks on the
Service is given or implied. All other brands and product names are the
trademarks of their respective owners.
C. TERMINATION
You agree that CRUIZIN’ CONCEPTS MOTORSPORTS’, in its sole discretion, may
terminate your use of and access to all or a portion of the Service, and remove
and discard any Content within the Service, for any reason, including, without
limitation, for lack of use, or if CRUIZIN’ CONCEPTS MOTORSPORTS believes that
you have violated this Agreement. You agree that any termination of your access
to the Service may be effected without prior notice, and acknowledge and agree
that CRUIZIN’ CONCEPTS MOTORSPORTS may immediately deactivate or delete your
account and all related information, Content, or other files in your account
and/or prevent any further access to such files or the Service. Further, you
agree that CRUIZIN’ CONCEPTS MOTORSPORTS shall not be liable to you or any third
party as a result of CRUIZIN’ CONCEPTS MOTORSPORTS’ termination of your access
to the Service.
D. ACCEPTABLE USE
In consideration for your use of the Service, you agree to provide true,
current, accurate, and complete information about yourself as requested during
the checkout process, and to update such information as may be necessary to keep
it true, current, accurate, and complete. You agree that you will use the
Service in a manner that complies with all applicable laws, and you acknowledge
that you are solely responsible for any Content that you upload, download,
transmit or otherwise process using the Service.
You explicitly agree to NOT:
- Transmit any Content
that infringes any patent, trademark, copyright, rights of publicity, or
other intellectual property right;
- Transmit any Content
that violates any applicable local, state, national, or international law
that could give rise to civil or criminal liability;
- Transmit any
unsolicited promotional Content, advertising materials, "spam," chain
letters, or other such solicitation;
- Transmit any Content
that solicits purchase of any product or service, unless that solicitation
has been explicitly approved in writing by CRUIZIN’ CONCEPTS MOTORSPORTS;
- Use the Service to
transmit Content that includes any virus, worm, Trojan-horse, sniffer, or
other code designed to acquire information about other users or disrupt the
functionality or availability of any computer program, database, the Service
or any other Internet host;
- Disguise your identity
by spoofing, forging headers, using third-party relays, or otherwise
obscuring the origin of transmitted Content, including impersonating another
person or entity; or
- Use any robot, spider
or other automatic or manual device or process to interfere or attempt to
interfere with the proper working of the Service, nor act as a conduit for
others to affect the same result.
E. THIRD PARTIES
Parties other than CRUIZIN’ CONCEPTS MOTORSPORTS
and its subsidiaries may operate stores, provide services, or sell product lines
on the Service. Additionally, the Service may offer links to the Web-sites of
affiliated companies and certain other businesses. CRUIZIN’ CONCEPTS MOTORSPORTS
shall not be responsible for examining or evaluating, and does not warrant the
offerings of, any of these businesses or individuals or the content of their
respective Web-sites. CRUIZIN’ CONCEPTS MOTORSPORTS assumes no responsibility or
liability for the actions, product, and content of all/any third parties. You
explicitly agree to carefully review their privacy statements and other
conditions of use.
F. ELECTRONIC
COMMUNICATIONS
By using the Service or by communicating with CRUIZIN’ CONCEPTS MOTORSPORTS
electronically via e-mail, instant messenger, or by other means, you consent to
receive communications from us electronically. You agree that all agreements,
notices, disclosures, and other communications that we provide to you
electronically satisfy any legal requirement that such communications be in
writing.
Furthermore, Cruizin Concepts and/or its other affiliated company sites may
record IP address in addition to other information pertaining to your identify.
This is only done for security purposes and is a firewall for preventing
fraudulent interactions. Any communication will be monitored for quality control
purposes.
G. RISK OF LOSS
All items purchased from CRUIZIN’ CONCEPTS
MOTORSPORTS are made pursuant to a shipment contract. The risk of loss and title
for such items shall pass to you upon CRUIZIN’ CONCEPTS MOTORSPORTS' delivery to
the carrier.
H. PRODUCT
DESCRIPTIONS
CRUIZIN’ CONCEPTS MOTORSPORTS attempts to be as accurate as possible with
respect to product descriptions. However, CRUIZIN’ CONCEPTS MOTORSPORTS does not
warrant that product descriptions or other Content of the Service is accurate,
complete, reliable, current, or error-free. If a product offered by CRUIZIN’
CONCEPTS MOTORSPORTS itself is not as described, your sole remedy is to return
it in unused condition subject to the terms of CRUIZIN’ CONCEPTS MOTORSPORTS'
Return Policy.
I. PRICING
CRUIZIN’ CONCEPTS MOTORSPORTS cannot confirm the
price of an item until an order is placed. Despite our best efforts, a small
number of items in our magazine adds and/or on our website(s) may be incorrectly
priced. On many occasions this can and may be due to limited time offers that
have not been recently expired and have not yet been updated to its original
price. If CRUIZIN’ CONCEPTS MOTORSPORTS discovers that an item is incorrectly
priced, CRUIZIN’ CONCEPTS MOTORSPORTS may do one of the following:
i. If the correct price of the
item is lower than that stated on or in our magazine adds or website, CRUIZIN’
CONCEPTS MOTORSPORTS will charge you the lower amount; or
ii. If the correct price of the
item is higher than that stated, CRUIZIN’ CONCEPTS MOTORSPORTS will, at its sole
discretion, either contact you for instructions before shipping or cancel your
order and notify you of such cancellation.
J. ORDER ACCEPTANCE
AND SUBMISSIONS
Your receipt of an electronic or other form of order confirmation does not
signify our acceptance of your order, nor does it constitute confirmation of our
offer to sell. CRUIZIN’ CONCEPTS MOTORSPORTS reserves the right at any time
after receipt of your order to accept or decline your order for any reason.
CRUIZIN’ CONCEPTS MOTORSPORTS reserves the right at any time after receipt of
your order, without prior notice to you, to supply less than the quantity you
ordered of any item and adjust your invoice accordingly. CRUIZIN’ CONCEPTS
MOTORSPORTS may require additional verifications or information before accepting
any order.
K. LIMITATION AND
LIABILITY OF DISCLAIMER
The CRUIZIN’ CONCEPTS MOTORSPORTS
Web-sites (www.CruizinConcepts.com or www.cruizinconceptswholesale.com) and the
materials therein are provided "AS IS". CRUIZIN’ CONCEPTS MOTORSPORTS makes no
representations or warranties either express or implied, of any kind with
respect to the operation, contents, information, or materials contained therein.
You agree that CRUIZIN’ CONCEPTS MOTORSPORTS, and its directors, officers,
employees or other representatives shall not be liable for damages arising from
the operation, content or use of the CRUIZIN’ CONCEPTS MOTORSPORTS Web-sites.
You agree that this limitation of liability is comprehensive and applies to all
damages of any kind, including without limitation direct, indirect,
compensatory, special, incidental, punitive and/or consequential damages.
Buyer agrees and understands that CRUIZIN’
CONCEPTS MOTORSPORTS is not responsible or liable for any possible damage and/or
injury incurred during accidents that may take place when using merchandise sold
by CRUIZIN’ CONCEPTS MOTORSPORTS. This includes accidents caused by driver
error, bad judgment, incorrect installations, and/or product instability such as
cracking and/or breaking of parts outside of what the involved manufacturer may
or may not cover. CRUIZIN’ CONCEPTS MOTORSPORTS and/or all affiliates and
distributors will not be held responsible for injury/death due to misuse of
items sold.
L.
JURISDICTION
Any legal action brought against/from CRUIZIN’ CONCEPTS MOTORSPORTS shall be governed by the laws of the State of Georgia without regard
to its conflict of law principles. You agree that the sole jurisdiction and
venue for any litigation arising from your use of, or orders made on CRUIZIN’
CONCEPTS MOTORSPORTS shall be an appropriate federal or state court located in
Bartow County, in the State of Georgia.
M. NON RECEIPT OF PAYMENT
All orders that are shipped and received without payment will be turned over to
our internal collections department after 7 days. In the event our internal
collection department does not receive payment within 7 business days of
notifying the customer about there outstanding balance it will then be sent to a
3rd party collections agency.
This unfortunately may have a
detrimental effect on your personal credit score. If collections does not
receive payment within there given time frame the customer may be subject to
being reported to all 40 Credit Bureau agencies.
Moreover, the
account can and may be reported
to other 3rd party organizations which network reaches thousands of
online and mail order merchants all over country which include many online
companies and online retailers. These organizations may eliminate your ability
to purchase goods at many major online merchants. This is integrated into many major online merchant’s website
infrastructures to help prevent fraudulent and/or high risk customer
transactions. However, as a Limited Liability Company we
do not intend to damage our customers credit history and ability to purchase
with other online retailers, but if the customer is absolutely unwilling
to pay for his or her bill, we will as a last resort do the above.
All returned checks
will be charged a $35.00 fee. Any chargeback’s issued by credit card will incur
a $125.00 fee. Please note: the chargeback fee cannot be refunded if and when in
most cases CRUIZIN’ CONCEPTS MOTORSPORTS’ dispute response overturns the
customers initiated chargeback. This fee is in part for representation for any
chargeback issued against CRUIZIN’ CONCEPTS MOTORSPORTS and for this reason is
non refundable.
N.
IN STORE CREDITS
All in store credits are good for one full
calendar year. Cruizin Concepst Motorsports reserves the right to refuse any
account credits that date older than 1 full calendar year. Any credits
authorized after this time period can only be authorized by an accounts
department representative and would be issued out of courtesy.
II. SHIPPING DAMAGE
Damage may occur occasionally in transit. Any damage incurred during transit is
the responsibility of the carrier; therefore damage claims must be filed
directly to the carrier. In case of damage, retain all cartons, packing
materials and damaged merchandise for the carrier to inspect. Never refuse
shipment or return it without approval, with the exception of Estes-Express
(See, “Once Products Have Shipped”). Your ability to be awarded a damage claim
may be denied by the transit company if you refuse any freight shipment without
our authorization (Estes-Express warrants authorized refusal of freight). If the
damage is apparent upon receipt, accept the merchandise and note the damage and
irregularities (such as crushed, torn, or broken packing) on the Freight bill
and have the driver sign it as verification. All parts must be inspected before
the driver leaves or else claims can be denied by the transit freight company.
If any damage has occurred, not it on the driver's bill and have him initial it
and make a copy for your records. All disputes as to the settlement amount or
manner should be addressed with the carrier. CRUIZIN’ CONCEPTS MOTORSPORTS under
no circumstances shall be liable for the damage merchandise or for subsequent
settlement of the claim with the carrier. If you need assistance a CRUIZIN’
CONCEPTS MOTORSPORTS customer service representative may facilitate your damage
claim process and/or may file the claim on the customers’ behalf.
(Also refer to “Returns and Exchanges” section 1 A
through B)
III. CANCELLATIONS
The customer may make a cancellation request at any time after an order has been
placed prior to the item(s) departure. All cancellations must be placed by phone
with a CRUIZIN’ CONCEPTS MOTORSPORTS customer service representative in order to
receive a cancellation number to finalize the request. Cancellations cannot be
made by the customer by voicemail, us mail or via email. There are no fees
associated with cancellations contingent the item(s) were not special order or
altered/modified/relocated to fill your order. We reserve the right to deny any
order cancellation request, especially if any of these following events were
required in order to fill your order.
You are responsible for any fees incurred during
pre-shipment. This may include items that require special packaging or labor
prior to shipment. For example; all mounted and balanced wheel and tire packages
may incur additional fees and/or restock fees due to labor and special packaging
that is required for these item(s) prior to shipment. We are reasonable, and in
the event that a cancellation is requested prior to any of these activities
taking place no fees will be evolved with your cancellation. If we agree to have
your order cancelled and removed from our system, then you the customer will
receive a cancellation number. If you have not received an order cancellation
number then your order is still active and has not been cancelled. Any order
without an order cancellation number will be considered an open/active order.
Due to the high volume of shipments there are times when our customer service
department who issues cancellations does not receive shipment
verification/tracking information on the packages being shipped out for up to
several days proceeding shipment. When our processing department is informed of
the products non-shipment, then the cancellation can be finalized and the
account closed. All order cancellations are subject to a 25% restock fee which
may be applied in concurrence or in addition to any other fees that CRUIZIN’
CONCEPTS MOTORSPORTS deems necessary.
CRUIZIN’ CONCEPTS MOTORSPORTS reserves the right
to reverse any order formally cancelled and finalized in the event the item(s)
cancelled shipped prior to date/time the cancellation number was recorded and
issued. This is in part due to the logistics of CRUIZIN’ CONCEPTS MOTORSPORTS
shipping item(s) from several warehouse facilities. Much times CONCEPTS
MOTORSPORTS customer service department may not receive tracking information
until several days after an item(s) departure. This is especially the case with
all made upon order items.
IV. CANCELLATION OF SPECIAL ORDERS/RETURNS
AND EXCHANGES OF SPECIAL ORDER ITEMS
Cancelled orders are subject to a restocking fee
for up to 25% which may be applied in concurrence or in addition to any other
fees that CRUIZIN’ CONCEPTS MOTORSPORTS deems necessary.
CRUIZIN’ CONCEPTS MOTORSPORTS reserves the right
to restrict or deny any return/exchange for special order items. Orders may not
be cancelled once they have been shipped and/or have left our facilities. All
returns/exchanges must be approved by CRUIZIN’ CONCEPTS MOTORSPORTS and are
subject to a 25% restock fee.
V. ONCE PRODUCT(S) HAVE SHIPPED
All body kits that have already been shipped or
delivered are non-refundable merchandise. CRUIZIN’ CONCEPTS MOTORSPORTS reserves
the right to deny and return/exchange for merchandise once it has been shipped
and/or delivered. If you receive any body kit component(s) damaged, then you
must immediately contact us so we can review your claim and potentially begin
the return/exchange process and/or issue a damage claim with the involved
carrier. CRUIZIN’ CONCEPTS MOTORSPORTS also reserves the right to deny any
exchange(s) and/or return(s) upon reviewing your claim.
A. INSPECT ALL
PACKAGES UPON DELIVERY AND NOTATE ANY DAMAGE/DISCREPANCY TO THE RECIEPT
AT TIME OF DELIVERY!
All packages MUST be inspected upon
delivery to ensure that a damage claim can be awarded with the 3rd
party shipping company/freight carrier. If any damaged packages and/or products
are not notated on the receipt of delivery at the time of delivery, then no
compensation can or will be guaranteed. CRUIZIN’ CONCEPTS MOTORSPORTS is not
responsible for compensation of any damage incurred during the shipment of any
products.
IF MERCHANDISE ARRIVES DAMAGED: DO NOT REFUSE ANY
FREIGHT SHIPMENTS OTHER THAN SHIPMENTS
DELIVERED BY ESTES-EXPRESS TRUCK FREIGHT!
Please note; shipments that arrive
damaged/otherwise via Estes-Express should be refused upon delivery. However, if
any/all other shipping companies/freight carriers deliver your merchandise
damaged/otherwise you SHOULD NOT REFUSE the merchandise. You should simply
notate the damage on the freight bill/receipt of delivery and accept the
merchandise. At that time a damage claim can be filed with the freight carrier.
Refusing the shipment upon delivery may result in your merchandise being refused
without proper RMA at our warehouse location(s), and you will be responsible for
any/all freight charges/fees or any other fees incurred.
B.
ALL RETURNED MERCHANDISE MUST RECEIVE PRIOR APPROVAL
From CRUIZIN’ CONCEPTS MOTORSPORTS and must have
a valid RMA (Return Merchandise Authorization) number issued by CRUIZIN’
CONCEPTS MOTORSPORTS. All authorized returns must be returned within 10 days
after being delivered. Any items received after 10 days or without approval from
CRUIZIN’ CONCEPTS MOTORSPORTS will be refused and returned to the purchaser at
his/her own expense. All returns must be in unused, unaltered, and unpainted
condition. All returns must be sent shipping prepaid. Any returns sent freight
collect will be refused and returned to the purchaser at their own expense. All
returnable items must be carefully packed in original packing (or better) if the
original packing is no longer in good condition. Purchaser is advised to insure
the returned goods for their full value for his own protection, since neither
CRUIZIN’ CONCEPTS MOTORSPORTS nor the shipping company would be responsible for
any damage or loss in shipment. Refunds will not be issued on returned
merchandise damaged on the way back to CRUIZIN’ CONCEPTS MOTORSPORTS. It is the
buyer's responsibility to insure the returned shipment. In the event returned
merchandise is damaged, CRUIZIN’ CONCEPTS MOTORSPORTS will file a claim with the
carrier and refund the purchaser upon settlement of the claim.
VI. RETURNS AND EXCHANGES
A member of our customer service staff must
authorize any return/exchange. Authorization is given by a number assigned by
CRUIZIN’ CONCEPTS MOTORSPORTS. Our Returns and Exchanges department must review
your case and then contact the involved manufacturer(s) of your product(s)
and/or the 3rd party shipping company(s) who delivered your products. This
process takes a minimum of 24-48 hours. Returns or exchanges may occur only if the
merchandise has been test fitted within (7) days of receiving the merchandise.
Any notification after this will be up to the sole discretion of a returns
and exchanges manager.
All returns must be sent back within 2 weeks of receipt. If approved by a claims
manager this time period can be extended to a maximum of 30 days. If extended
all products must arrived back to there origin facility within 30 days of
receipt or a mandatory 25% restocking fee may be imposed. Cruizin Concepts
Wholesale reserves the right to deny any exchange and/or return.
RETURNS
WITH THE FOLLOWING DISCREPANCIES WILL INCUR A MANDATED RESTOCKING FEE:

Restocking fees on the following items will be up to the sole
discretion of a returns and exchanges agent.
Returned item(s) that are missing parts or hardware
Returned items missing any original packaging
Returned item(s) without prior authorization
Returned Products that have been modified
RETURNS ON THE FOLLOWING ITEMS HAVE A MANDATED RESTOCKING FEE:
Returns can be denied on any of the following products. Any item(s)
that are approved for a return, will induce a mandatory restocking fee.
Wheel & Tire Combinations - (25%-45%)
Body Kits - (25%)
Hoods - (25%)
Wings/Spoilers - (25%)
Light Bars/Styling Bars - (5%)
Performance Parts - (15%)
Most other products do not induce any restocking fees contingent the item(s) are returned
within there given chronological time period.

RETURNS ARE NOT ACCEPTED ON THE FOLLOWING ITEM UNLESS AUTHORIZED:
- Wheel & Tire Packages
- Wheels that have been mounted previously to a tire
- Special Order or Made to order items
(Product 1 Wheel & Tiackages)
These items may notbe
returned unless authorized bya reurs and exchanges manager. These items
require special labor and handling. Thus, in the event a return is approved, a
mandatory 5% - 45% restockin fee is imposed. This cannot be negotiated.
CRUIZIN CONCEPTS MOTORSPORTS certified technicians are provided on behalf of
the customer at no additional charge with the purchase of these packages. Thus,
we impose on all authorized returns a restocking fee, in order to cover our
expense regarding these services.
(Product 2 Wheels that have been previously mounted on tires)
These items may not be returned unless authorized by a returns and exchanges
manager. These items are considered used merchandise once mounted with a tire.
Thus, returns are generally not accepted for this reason. In the event a return
is approved there will be a mandatory 25% - 45% restocking free. This
merchandise will likely be auctioned off at large discount and can no longer be
sold on the Cruizin Concepts and/or affiliated websites.
(Product 3 Special Order or Made to order items) Many special
order items are not returnable with the manufacture. In the event a special
order item is returnable with the corresponding manufacturer it is likely there
will be a mandatory restocking fee in order for the product to be returned.
Returns are up to the discretion of a claims manager on these products. If a
return is approved a mandatory 25% restocking free is charged.
VII.
REFUNDS
Refunds are generally issued within 48 hours of
your item(s) return. Refunded will be issued by means of the original
payment method. To insure that your account is refunded in a timely manner,
please email the shipping department with your return tracking information.
Representatives will then be able to trace your items return.
VIII.
REFUNDS
Refunds will not be issued on returned items that
are received in damaged and/or altered condition. Any refund amount for such
items must be authorized by a returns and exchanges agent. These agents will
have full discretion as to the refund amount.
A. IF
MERCHANDISE ARRIVES DAMAGED
CRUIZIN’ CONCEPTS MOTORSPORTS is not liable or
responsible for any shipments that arrive damaged. If you receive merchandise
damaged, you must notate the freight bill and/or receipt upon receiving your
product(s) and any damages must be reported to the shipping company/freight
carrier immediately. CRUIZIN’ CONCEPTS MOTORSPORTS must be informed of the
damage immediately as well. All of our merchandise is shipped insured. However,
insurance reimbursement may not be awarded if correct protocol is not followed.
You the customer are responsible to contact CRUIZIN’ CONCEPTS MOTORSPORTS and/or
the involved shipping company/freight carrier as well as notating any
discrepancy with the merchandise on the freight bill/receipt at the time of
delivery. Even when the proper procedure is followed insurance awards are not
guaranteed as they are assessed by carrier who delivered your merchandise and
deemed valid by that entity and not by CRUIZIN’ CONCEPTS MOTORSPORTS.

i.
IF FREIGHT BILL/RECEIPT IS NOT NOTATED UPON DELIVERY
(IN CASES OF MERCHANDISE ARRIVING DAMAGED)
CRUIZIN’ CONCEPTS MOTORSPORTS is not liable or responsible for any shipments
that arrive damaged, especially if product(s) are not inspected upon delivery.
If the freight bill and/or receipt are not notated of the discrepancy upon
inspection of the delivered merchandise a damage claim must be formally filed
with the carrier in order to receive any compensation or exchange for the
product. This process can be filed by the customer or can be done by the
shipper. Any item(s) allegedly damaged may be denied by the carrier on the
premise there is no proof that the merchandise delivered was damaged unless
special notation is made on the freight bill and/or receipt. In these cases the
CRUIZIN’ CONCEPTS MOTORSPORTS claims department can facilitate the customer in
the process of filing all damage claim paperwork with the corresponding carrier.
This service can and only will be provided at the customers request. CRUIZIN’
CONCEPTS MOTORSPORTS has the right to deny any claim for merchandise arriving
damaged if (1) freight bill isn’t notated upon the arrival of the merchandise
and/or (2) if CRUIZIN’ CONCEPTS MOTORSPORTS is not notified immediately about
the damaged merchandise. (Also refer to the
“Shipping Damage” section)
ii. IF FREIGHT BILL/RECEIPT IS NOTATED OF DAMAGE
(IN CASES OF MERCHANDISE ARRIVING
DAMAGED)
If packages are inspected upon delivery and the freight bill/receipt is properly
notated of the damage and/or discrepancy, then CRUIZIN’CONCEPTS MOTORSPORTS can
initiate a damage claim with the 3rd party freight carrier and/or
shipping company that delivered your product(s). If the freight carrier and/or
shipping company awards a claim for the damaged/lost product, then CRUIZIN’
CONCEPTS MOTORSPORTS can give either fully or partially recompense you for the
product(s) damaged. CRUIZIN’ CONCEPTS MOTORSPORTS is not responsible for awards
given and must adhere to the guidelines set by the 3rd party shipping
company/freight carriers involved. (Also refer to
the “Shipping Damage” section)
B. ALL LOST OR
DAMAGED MERCHANDISE
In the event merchandise is damaged/lost during freight/shipment, CRUIZIN’
CONCEPTS MOTORSPORTS is not responsible for any compensation and/or discounts on
the damaged/lost products. Also, CRUIZIN’ CONCEPTS MOTORSPORTS is never
responsible for any 3rd party shipping charges. Therefore, the
customer is responsible for origination shipping and return shipping charges if
a return is authorized by CRUIZIN’ CONCEPTS MOTORSPORTS (See Returns/Exchanges
for further detail). If CRUIZIN’ CONCEPTS MOTORSPORTS authorizes an exchange,
you the customer, are also responsible for shipping charges for your replacement
component(s).
All packages MUST be inspected upon delivery to ensure that a damage claim can
be processed with the 3rd party shipping company/freight carrier. If
any damaged packages and/or products are not notated on the receipt of delivery,
then no compensation can or will be guaranteed. CRUIZIN’ CONCEPTS MOTORSPORTS is
not responsible for compensation of any damage incurred during the shipment of
any products.
BODYKIT COMPONENTS (Includes all polyurethane,
poly-fiber, dura-flex, carbon-fiber and fiberglass based components such as
bumpers, fenders, side skirts, side scoops (c-scoops or rocker panels), hoods,
deck lids, spoilers, window scoops, etc:
All our body kits are carefully packaged and
inspected before they are shipped. We do not ship damaged products.
IX. IF MERCHANDISE IS LOST DURING SHIPMENT
In any and all circumstances of merchandise damaged/lost during
shipment, CRUIZIN’ CONCEPTS MOTORSPORTS must work with the guidelines and
procedures set forth by the involved carrier(s) who delivered/attempted to
deliver your merchandise. The company that delivers or attempts to deliver your
product(s) is a 3rd party separate entity and is not represented by
CRUIZIN’ CONCEPTS MOTORSPORTS, nor is CRUIZIN’ CONCEPTS MOTORSPORTS represented
by them.
In such cases, a damage/loss claim must be
submitted with the involved shipping company/freight carrier. Once a damage/loss
claim is submitted, the process can take up to (30) days for an investigation to
be completed and is carried out by the involved shipping company/freight
carrier.
CRUIZIN’ CONCEPTS MOTORSPORTS is NOT responsible for shipping you the customer
more merchandise/reshipping your order if your original order is lost and/or
delayed during shipment. CRUIZIN’ CONCEPTS MOTORSPORTS is not obligated to give
you any type of refund, credit and/or discount whether partial or full, if your
merchandise is lost or delayed in freight.
X. FITMENT ISSUES
All parts must be test fitted promptly upon
receiving your products, and any fitment issues must be reported within 7 days
upon receiving your product(s).
WARNING: PREPARING, PRIMING, PAINTING, OR IN ANY OTHER WAY MODIFYING MERCHANDISE
VOIDS MANUFACTURERS WARRANTY.
No refunds, returns, and/or exchanges will be
permitted on products that have been modified. We cannot issue a
return/exchange, and/or refund for any component(s) once they have been
modified. Be sure to inspect all packages upon delivery, and test fit all
products before modifying. Be sure to test fit all merchandise and report any
discrepancies to Cruizin’ Concepts Motorsports within (7) days or your claim
will be denied. Your claim will be denied if your parts have been modified in
any way.
ADDITIONAL MODIFICATIONS
MAY BE REQUIRED!
Buyer understands that all Body kit components
may require modifications for correct fitment such as the removal or
modification of factory components including but not limited to bumper lighting,
side marker indicators, factory side scoops, etc. Body kits typically require
some prep work and/or modifications before priming/painting and installation at
a professional body shop is highly recommended.
XI. INSTALLATIONS
Again, all body kits and body kit components are sold "AS IS" and it is
the customers’ responsibility to be aware of potential work involved in the
installation process and that there is preparatory work and/or modifications
that are often required for installation. Customer understands that all body
kits are not direct “bolt-on“, and in many cases, factory hardware and/or other
materials may be required for the installation process. CRUIZIN’ CONCEPTS
MOTORSPORTS is not responsible for these materials. CRUIZIN’ CONCEPTS
MOTORSPORTS will not be held responsible for fitment issues. Sometimes it is
possible a fiberglass kit may need a lot of prep work including filling gaps,
trimming, or grinding. CRUIZIN’ CONCEPTS MOTORSPORTS recommends that the retail
customer seek an experienced custom shop to do the install on body kits and know
all the procedures, of installing fiberglass kits. We do not recommend a
collision shop to do installs on body kits, they are only experienced on
installing OEM parts that are direct bolt-on and do not know the procedure of
installing fiberglass body kits.
XII. SAFETY STANDARD/REQUIREMENTS OF COMPONENTS/ILLEGAL USE OF MERCHANDISE
Because many body kit components and other
merchandise that we offer are designed, prototyped, and manufactured outside of
the U.S.A. there may be some safety standards and/or requirements from their
respective countries of origin that could differ from those of the U.S.A. It is
your responsibility to make whatever necessary modifications required for legal
street use based on the safety requirements and standards in the region you will
be operating your vehicle/using our components.
Also, much of the merchandise that we offer is used for show cars and/or track
cars. If you plan on using parts that are not meant to be used on public roads,
hence, are not street legal, then you do so without our consent. Again, it is
your responsibility to make whatever necessary modifications required for legal
street use based on the safety requirements and standards in the region you will
be operating your vehicle/using our components.
CRUIZIN’ CONCEPTS MOTORSPORTS is not liable for any illegal street use of these
components. CRUIZIN’ CONCEPTS MOTORSPORTS is not responsible for any
fines/charges and/or repercussions from using these components and/or using them
in an illegal or unwise manner.
